These Terms govern the use of our website, mobile application, marketplace, machinery booking, workforce booking, veterinary services, and peer-to-peer marketplace.

Pesticides & Fertilizers – Terms & Conditions

1. Legal Compliance

Kisanbhoomi is committed to ensuring that all pesticides, fertilizers, and other regulated agricultural inputs offered through the platform comply with applicable laws and regulations in India, including the Insecticides Act, 1968, the Insecticides Rules, 1971, the Fertilizer (Control) Order, 1985 (FCO), and other relevant government notifications.

All sellers listing regulated agricultural products on the platform are responsible for maintaining valid licenses, registrations, and approvals required under applicable law. Kisanbhoomi reserves the right to suspend or remove listings that do not comply with legal or regulatory requirements.

2. Purchase Eligibility & License Requirements

Certain pesticides, fertilizers, or restricted agricultural products may only be sold to eligible individuals or entities as permitted under applicable law.

Where required, buyers may be asked to provide supporting documentation, including but not limited to:

• Valid agricultural or pesticide license
• Aadhaar-linked Kisan ID
• Government-issued identity proof
• Any additional documents required by regulatory authorities

Kisanbhoomi reserves the right to verify submitted documents before processing an order. Orders that do not satisfy statutory or regulatory requirements may be rejected, cancelled, or refunded without prior notice.

3. Product Usage & Safety Disclaimer

All pesticides, fertilizers, and crop protection products must be used strictly in accordance with the manufacturer's instructions, dosage recommendations, safety precautions, and applicable agricultural guidelines.

Users are solely responsible for:

• Following the instructions provided on the product label.
• Using appropriate protective equipment while handling chemicals.
• Applying products only for their intended agricultural or horticultural purposes.
• Complying with all applicable local, state, and national regulations.

FLTY Services Private Limited, Kisanbhoomi, sellers, and manufacturers shall not be liable for any crop damage, health hazards, environmental impact, or financial losses resulting from improper storage, misuse, overuse, incorrect application, or unauthorized mixing of products.

4. Shipping & Delivery Restrictions

Pesticides, fertilizers, and other regulated agricultural products will only be delivered to locations where their sale, transportation, and distribution are legally permitted.

Delivery may be restricted or unavailable in certain regions due to:

• State-specific agricultural regulations
• Hazardous material transportation restrictions
• Government notifications or prohibitions
• Courier or logistics limitations

Delivery timelines may vary depending on regulatory approvals and transportation requirements.

5. Returns, Replacements & Refunds

Due to the nature of agricultural chemicals and safety regulations:

• Opened, used, tampered, or partially consumed products are not eligible for return.
• Returns will only be considered for products that are damaged during transit, leaking, expired, defective, or incorrectly delivered.
• Any such issues must be reported within 48 hours of delivery through the Kisanbhoomi support channels.
• Refunds or replacements will be processed only after verification of the reported issue and approval by the seller or the Company.

Kisanbhoomi reserves the right to reject claims that do not meet the applicable return conditions.

6. Storage & Handling Responsibilities

After successful delivery, the responsibility for the safe storage, handling, transportation, and usage of pesticides and fertilizers rests solely with the buyer.

Buyers are advised to:

• Store products in a cool, dry, and well-ventilated location.
• Keep products in their original containers with labels intact.
• Keep all agricultural chemicals away from children, pets, livestock, food items, drinking water sources, and animal feed.
• Dispose of empty containers and unused chemicals in accordance with applicable environmental and agricultural regulations.

7. Limitation of Liability

FLTY Services Private Limited and Kisanbhoomi act as an online marketplace connecting buyers with authorized sellers.

To the maximum extent permitted by law, the Company shall not be liable for:

• Crop failure or reduced yield
• Incorrect product selection by the buyer
• Improper application of pesticides or fertilizers
• Adverse weather conditions
• Soil conditions
• Pest resistance
• Misuse or negligent handling of products

• Consequential or indirect losses arising from the purchase or use of agricultural chemicals

8. Buyer Indemnification

By purchasing pesticides, fertilizers, or other regulated agricultural products through Kisanbhoomi, the buyer agrees to indemnify, defend, and hold harmless FLTY Services Private Limited, Kisanbhoomi, its directors, employees, affiliates, sellers, partners, and service providers from and against any claims, liabilities, damages, penalties, losses, costs, or expenses arising out of:

• Misuse or improper application of products.
• Violation of applicable laws or regulations.
• Failure to follow manufacturer instructions.
• Unauthorized resale or distribution of regulated products.
• Negligence or unlawful activities related to the purchased products.
